There are multiple reasons why we chose to address these issues. First, drugs are often found on a person due to law enforcement’s violation of the Fourth Amendment. Cases which stem from an illegal seizure can, depending on the circumstances, possibly be dismissed due to a constitutional violation. Second, prosecutors aggressively pursue charges involving heroin due to the current “opioid epidemic” in the U.S. Third, while many think that cases involving pills are “no big deal,” the fact of the matter is that a defendant will face serious consequences and be treated in same manner as someone accused charges with “harder” drugs. Fourth, while some drug cases may be viewed as minor, those involving trafficking or distribution will most certainly be taken seriously.
