Texas THC Rules Have Changed. Here’s What You Need to Know.

Yes. Manufactured delta-8 THC is now treated as a controlled substance in Texas.

Beginning July 31, 2026, Texas reinstated controlled-substance definitions affecting manufactured delta-8 and certain other THC products that had previously been sold openly in smoke shops, CBD stores, convenience stores, gas stations, and online.

However, this does not mean every THC, CBD, or hemp product is now illegal.

Here is what Texans need to know.

What Changed in the Texas THC Laws?

The change followed a May 1, 2026, decision from the Texas Supreme Court in Texas Department of State Health Services v. Sky Marketing Corp.

The Court ruled that the Texas Department of State Health Services had the authority to include manufactured delta-8 THC in the Texas controlled-substance schedules. The ruling removed the injunction that had prevented the state from enforcing its position. (Texas Courts)

Texas DSHS then reinstated its earlier definitions of “tetrahydrocannabinols” and “marihuana extract,” effective July 31, 2026. (Texas Health Services)

As a result, some products that were previously available on store shelves may no longer be legal to sell or possess.

Is Delta-8 THC Illegal in Texas?

Manufactured delta-8 THC is treated as a controlled substance in Texas.

Texas DSHS explains that only trace amounts of delta-8 THC naturally produced by the hemp plant are permissible. Products labeled as containing delta-8 THC, or found to contain more than naturally occurring trace amounts, may be detained and referred to law enforcement. (Texas Health Services)

This affects many products made by chemically converting hemp-derived CBD into concentrated delta-8 THC.

What Types of Products Are Affected?

The restrictions are based on what a product contains—not whether it is a gummy, vape, drink, or another type of product.

Examples of products that may contain manufactured delta-8 or another prohibited THC compound include:

  • Delta-8 gummies and candies
  • Delta-8 vape cartridges
  • Disposable delta-8 vape pens
  • THC-infused drinks
  • Chocolates and other edibles
  • Tinctures and oils
  • THC concentrates
  • Hemp flower sprayed or infused with manufactured THC
  • Products marketed as containing synthetically derived THC compounds

Several synthetically derived THC products are affected by the reinstated definitions. The exact legality of a particular product depends on its chemical composition, concentration, and laboratory testing. (The Texas Tribune)

A product is not necessarily legal simply because the package says “hemp-derived,” “Farm Bill compliant,” or “legal THC.”

Does This Mean All THC Products Are Illegal in Texas?

No.

It would be inaccurate to say that Texas banned every THC product.

Hemp-derived products containing no more than 0.3% delta-9 THC by dry weight may remain legal if they otherwise comply with Texas law. Compliant CBD products may also remain legal.

Recent reporting on the change confirms that qualifying delta-9 products remain legal despite the restrictions affecting delta-8 and other synthetically derived cannabinoids. (The Texas Tribune)

The important question is not simply whether a product says “THC” or “hemp” on the package.

The important question is what the product actually contains.

Are All THC Gummies Illegal in Texas?

No.

A gummy is not automatically illegal simply because it contains THC.

A gummy containing manufactured delta-8 THC may be treated as containing a controlled substance. A qualifying hemp-derived delta-9 gummy may remain legal if it stays within the applicable legal limit and otherwise complies with Texas law.

Two products may look nearly identical while containing completely different cannabinoids.

Are Delta-9 Gummies Still Legal in Texas?

Certain hemp-derived delta-9 products remain legal under current Texas law.

To qualify as hemp, the product must remain within the legal delta-9 THC concentration limit and comply with other state requirements. Products exceeding that limit may be treated differently.

The wording on the package alone does not prove that a product is legal. The product's ingredients, concentration, testing, and actual chemical composition matter. (The Texas Tribune)

Is CBD Still Legal in Texas?

Compliant CBD products may remain legal.

However, consumers should read the label carefully because some products marketed as CBD may also contain delta-8 or other THC compounds.

The ingredient list, certificate of analysis, batch information, and laboratory testing may become important when determining what the product actually contains.

What if I Bought the Product at a Store?

Many people reasonably assume a product must be legal because it was purchased from a local business.

Unfortunately, buying a product from a smoke shop, convenience store, CBD store, gas station, or online retailer does not guarantee that it is legal to possess.

The fact that a product was purchased from a store may still be relevant to what a person knew or believed. However, it does not automatically prevent an arrest or criminal charge.

Can You Be Arrested for Possessing Delta-8 in Texas?

A person found with a product that law enforcement believes contains a controlled substance could face criminal charges.

However, an arrest does not automatically mean the State can prove its case.

Important issues may include:

  • What cannabinoid the product actually contained
  • Whether the product was properly tested
  • The amount or weight attributed to the product
  • Whether the accused knowingly possessed it
  • Where the product was found
  • Whether police conducted a lawful search
  • Whether the evidence was properly handled
  • Whether the laboratory results are reliable

Gummies, liquids, oils, vape cartridges, and other products may require laboratory analysis before the State can establish what substance was actually present.

What Should You Do if Police Find a THC Product?

You have the right to remain silent.

Do not try to explain the product's ingredients, where it came from, or what you believed it contained before speaking with an attorney.

You should also avoid consenting to a search simply because an officer asks. Whether police had legal grounds to search your vehicle, home, bag, or belongings may become an important issue in your case.

If you are arrested or charged:

  • Do not discuss the case on social media
  • Do not destroy the packaging or receipt
  • Save any online order confirmation
  • Save photographs of the label and packaging
  • Contact a criminal defense attorney as soon as possible

The original packaging may contain important information about the ingredients, manufacturer, batch number, and claimed THC concentration.

Charged With Delta-8 or THC Possession in Laredo?

THC possession cases in Laredo and Webb County may involve gummies, disposable vape pens, cartridges, oils, concentrates, drinks, or infused hemp flower.

The product's label alone does not determine whether the State can prove that it contained a controlled substance.
